The prosecution decided to seize the parents of the newlyweds pending the investigations that were assigned the criminal investigations, as the legal age of the girl was verified, and to ensure whether she was minor or under pressure to complete the marriage, which was evident in the short video in which she appears crying and conservative during the wedding ceremony.
In a related context, the prosecution decided to hand over the minor bride to her mother, after obtaining a legal pledge not to marry her before reaching the legal age scheduled under Egyptian law.
Investigations also showed that the marriage contract was not formal, but rather in a customary manner by a non -competent person, which opens a new door in the case regarding the entities or individuals involved in making this contract, without legal or legal basis.
Crime of an indecent assault
For her part, Lawyer Noha Al -Jundi revealed in exclusive statements to “24” that the incident represents an explicit legal crime, explaining that “the marriage of the minor is considered in accordance with the Egyptian Penal Code to release a presentation, and the law is punishable by Article 267.”
The soldier explained that the groom – given his health – is not criminally asked, and that full responsibility falls on the families of both parties, especially since the girl did not reach the legal age and was not aware of the seriousness of the situation.
She added that the most prominent surprise was that the marriage was not concluded by a legal authorization, but rather through another person who does not carry any legal or religious characteristic that the marriage contract authorizes, which confirms the existence of a clear intention to overcome official procedures and manipulate the law.
In her statements, the Egyptian lawyer added that the role of the judiciary is full of family crises and the problems of separation, which destroys families in which the family is full of eligibility, so despite the fact that the marriage of people with Down syndrome is valid legally and legally, it must be carefully considering completing it in such circumstances.
